RockStar texting Service Agreement
By accepting the terms of this service agreement you are agreeing to pay the provider $15 per month. Provider agrees to issue User the use of short code 411247 for text messaging that is exclusive for the User’s sole benefit which pertains to any and all advertising and marketing campaigns in association with the marketing and advertisement of bands only and cannot be sold, transferred, leased, donated or given with or without compensation in any manner without the express written consent of the Provider. In the event that User is using Bandname Texts services for the marketing and advertisement of another company/service other than the promotion/marketing of events and music in conjunction and or related to building a bands database Bandname Texts has the right to cancel Users account. Inbound Text Messages are FREE and outbound Text Messages, including auto responses and blasts, must be purchased in advance at the rate of:
Prices are for standard SMS texts only. WAP/Media/Recorded Voice Texts are a flat rate of .08 a text. Text credits may be purchased through The Campaign Manager Billing Tab (which is located on the main page of the Campaign Wizard). Text credits are in addition to the monthly subscription fee. Provider agrees to credit user with 100 initial start up Text Message Credits. These credits will show up upon initial set-up. Credits roll over from month to month and do not expire.
Support: we offer an extensive user friendly knowledge base support system for all of our clients. Email support for our 'Indie' and 'Major' clients and live call in technical support for our 'Major' clients.
User is not required to purchase any additional equipment or supply any technical assistance for the use of the text message code or "keyword(s)." Provider agrees to assist User in the initial set up and launch of text message code campaign for User. Provider may cancel or delete any 'Keyword' or 'Account' at any time for any reason. All 'Keywords' are the property of Bandname Texts/DigiMark, LLC. Local plan includes 1 keyword, Indie plan includes 2 keywords, and the Major plan includes 3 keywords. Additional keywords can be purchased for a fee of $10 a month. A maximum of 20 keywords can be ACTIVE at any given time. Provider agrees not to sell or give access to any opt-in databases to anyone other than the User. User also agrees not to sell or give access to any outside person, company or services. Provider agrees not to solicit to or 'SPAM' any of User's clients or databases. User agrees not to 'SPAM' or send unsolicited text messages to non-opt in databases. EXCULPOTORY AND RELEASE CLAUSE: User shall release Provider of any liability for, and shall protect, defend and indemnify Provider, its managers or employees from and against all claims, demands, and causes of action of every kind and character, without limit and without regard to the cause or causes thereof for any misrepresentations made by User during any campaign. In addition, Provider will not be held liable including but not limited to negative impact to the User, its affiliates, or principles, for any inbound or outbound delay or failure to deliver any text message(s) outside the direct or indirect control of the Provider. Provider will draft Users banking institution (credit card/debit/etc) or email an invoice once a month. This agreement will renew each month unless written cancellation is received by the company. Once written cancellation is received you will be required to fill out a cancellation form that will be emailed to you.
